Definitions

In these Terms, the following words have the meanings set out below:

  • "Affiliated Brand" means any product, platform, or service operated by or in partnership with 9 Realms that is designated as an affiliated brand, as notified to users at the point of account connection.
  • "Connected Account" means a third-party game platform account that a User has authorised SupernovaIQ to access for the purpose of retrieving User Data through the applicable Third-Party Game Platform's official API or authorisation mechanism.
  • "Founder Runes" means the Loyalty Coins issued within Supernova iQ, currently branded as Founder Runes (ᚨ Ansuz), earned through platform activity including gameplay, referrals, daily streaks, and coaching sessions. References to Loyalty Coins in these Terms include Founder Runes.
  • "GDPR" means Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation).
  • "Loyalty Coins" means non-cash digital units issued within the Services for use in accordance with these Terms, including units currently branded as Founder Runes (ᚨ Ansuz).
  • "Operating Entity" means Rectech Gaming Pty Ltd (ABN 75 667 230 766), the entity currently providing the Services on behalf of 9 Realms.
  • "9 Realms" means 9RE Ltd (trading as 9 Realms Entertainment) and its related entities and services, including its operating entity Rectech Gaming Pty Ltd.
  • "Personal Data" has the meaning given to it under applicable data protection laws, including (where applicable) the GDPR, UK GDPR, the Privacy Act 1988 (Cth), and the California Consumer Privacy Act (CCPA).
  • "Platform Outputs" means any analytics, insights, reports, models, recommendations, or other outputs generated by the Services.
  • "Privacy Policy" means the privacy policy made available by 9 Realms in connection with the Services, available at supernovaiq.com/privacy.
  • "Services" means the Supernova iQ platform and all features, functionality, analytics, tools, and related services made available through it.
  • "Supernova iQ" means the gaming analytics and AI coaching service operated by 9 Realms, including prior versions known as Supernova iQ.
  • "Terms" means these Terms of Use.
  • "Third-Party Game Platform" means any third-party gaming platform integrated with the Services, as listed on our Supported Platforms page at supernovaiq.com/platforms from time to time.
  • "UK GDPR" means the General Data Protection Regulation as it forms part of domestic law in the United Kingdom by virtue of the European Union (Withdrawal) Act 2018.
  • "User" means any individual who accesses or uses the Services.
  • "User Content" means any content, data, or materials provided, uploaded, or submitted by a User in connection with the Services.
  • "User Data" means gameplay data, account data, or other information provided or made available by a User for analysis through the Services, including data retrieved from Connected Accounts.
  • "Wallet" means the digital wallet feature within the Services used to hold and manage Loyalty Coins.

1. Introduction & Acceptance

Please read these Terms carefully before using Supernova iQ (formerly known as Supernova iQ), operated by 9 Realms through its Operating Entity, Rectech Gaming Pty Ltd ("9 Realms", "we", "us", or "our").

Supernova iQ forms part of 9RE Ltd (trading as 9 Realms Entertainment), a company headquartered in Cyprus. These Services are provided at supernovaiq.com (formerly supernova-analytics.com).

Supernova iQ is a free gaming analytics and AI coaching service that provides users with insights, performance analysis, and related features based on gameplay data.

By accessing or using Supernova iQ, including creating an account, accessing features, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

References to Supernova iQ include prior versions of the service known as Supernova iQ.

2. Services

Supernova iQ provides free gaming analytics and AI-driven coaching services designed to deliver insights, performance analysis, and recommendations based on user gameplay data.

The Services may include access to analytics dashboards, performance metrics, historical data analysis, coaching insights, and other related features made available from time to time.

The analytics, insights, and recommendations provided through Supernova iQ are informational and descriptive in nature. They do not constitute financial advice, investment advice, trading advice, or betting advice, and do not guarantee any performance, outcome, or result.

Users are solely responsible for any decisions made based on Platform Outputs, including decisions relating to gameplay, spending, or participation in third-party services.

Use of Supernova iQ does not provide access to, or imply acceptance of, any other 9 Realms service. Each service operates under its own terms and conditions.

We may promote or make available information about other 9 Realms services within Supernova iQ.

3. Accounts & Eligibility

To use Supernova iQ, you must be at least 18 years of age, or the age of legal majority in your jurisdiction, and have the legal capacity to enter into these Terms. By registering, you confirm that you meet this requirement.

Where we have reasonable grounds to believe a User is under the applicable minimum age, we reserve the right to immediately suspend or terminate the account and delete associated data, subject to any legal obligations to retain it.

Users under the age of 16 (or 13 in the United Kingdom) may not use the Services without verifiable parental or guardian consent. If you become aware that a minor has accessed the Services without appropriate consent, please contact us at privacy@supernovaiq.com.

You are responsible for ensuring that all information you provide in connection with your account is accurate, complete, and kept up to date.

You are responsible for maintaining the confidentiality and security of your account credentials and any associated access to the Services. You must not share your account or permit access to any third party.

You are responsible for all activity that occurs under your account, whether or not authorised by you.

We may suspend or restrict access to your account where we reasonably believe that your account has been compromised, is being misused, or is in breach of these Terms.

You must comply with all applicable laws and regulations when using the Services.

4. Payments & Subscriptions

Supernova iQ is currently provided entirely free of charge. There are no subscription fees, paywalls, or premium tiers at this time. The following provisions apply to any paid features that may be introduced in the future and to connected 9 Realms services where payments are applicable.

Supernova iQ may offer both free and paid features in the future. Access to certain features, analytics, and content may require payment of fees as specified within the platform.

Where fees apply, Services are provided on a prepayment basis. Access to paid features is granted for the applicable subscription period based on the selected plan.

Where subscriptions are set to auto-renew, we will notify you of the upcoming renewal and applicable fee at least [7] days in advance of the renewal date. You may cancel auto-renewal at any time through your account settings prior to the renewal date.

We may introduce, modify, or remove fees, subscription plans, or pricing for the Services at any time. We will provide at least [30] days' notice of material changes to pricing or subscription structure.

Where required by applicable law — including the EU Consumer Rights Directive and the UK Consumer Rights Act 2015 — Users may have the right to cancel a subscription within 14 days of purchase (the "Cooling-Off Period"). By requesting immediate access to the Services upon purchase, you acknowledge that performance of the Services has begun and that you may thereby lose your right to cancel during the Cooling-Off Period.

Nothing in these Terms limits or excludes any rights or remedies that cannot be excluded under applicable law.

5. Wallet & Loyalty Program

Supernova iQ provides a Wallet and a loyalty program through which Users can earn, receive, hold, and use Loyalty Coins within the Services. Within Supernova iQ, Loyalty Coins are currently branded as Founder Runes (ᚨ Ansuz), earned through platform activity including gameplay, referrals, daily streaks, and coaching sessions.

The Wallet and Loyalty Coins may form part of a broader 9 Realms ecosystem.

While Loyalty Coins within Supernova iQ have no cash value and cannot be redeemed for fiat currency within the Services, other 9 Realms services may permit different uses, conversions, or redemptions under their own terms. Any such functionality is governed exclusively by the terms of the relevant service and does not apply within Supernova iQ.

The Wallet records a User's Loyalty Coin balance and permitted in-platform uses. Loyalty Coins are issued by 9 Realms as part of a closed-loop system and are licensed, not sold, to the User.

Loyalty Coins are earned through activities designated by 9 Realms from time to time, including referrals, promotions, in-app activity, or other engagement-based actions. 9 Realms determines eligibility, conditions, and availability of such activities.

6. Privacy & Data Handling

We collect, use, and process personal information in connection with the Services in accordance with our Privacy Policy, available at supernovaiq.com/privacy. By using Supernova iQ, you acknowledge that your information will be handled in accordance with the Privacy Policy and these Terms.

Lawful Basis for Processing

We process User Data on the following lawful bases:

International Data Transfers

Use of the Services may involve the transfer, storage, and processing of data across different jurisdictions, including locations outside your country of residence. Where data is transferred outside the European Economic Area (EEA) or United Kingdom, we take appropriate safeguards including, where applicable, Standard Contractual Clauses approved by the European Commission or equivalent mechanisms recognised under UK law.

Data Retention

We retain User Data for as long as your account is active or as necessary to provide the Services, and thereafter for such period as may be required by applicable law. Upon account closure or upon receipt of a verified deletion request, we will delete or anonymise your data within [30] days, except where we are required by law to retain it for longer.

Data Security & Breach Notification

We implement appropriate technical and organisational measures to protect User Data against unauthorised access, disclosure, alteration, or destruction. In the event of a personal data breach that is reasonably likely to result in a risk to your rights and freedoms, we will notify you and applicable regulatory authorities within the timeframes required by applicable law.

7. Use of Services (Acceptable Use)

You may use Supernova iQ only for its intended purpose and in accordance with these Terms.

You must not:

We may suspend or restrict access where we reasonably believe these Terms are breached.

8. Data Ownership & Rights

You retain ownership of User Data, including data retrieved from Connected Accounts, subject to the terms of applicable Third-Party Game Platforms.

Once User Data is retrieved from a Third-Party Game Platform and stored within the Services, 9 Realms treats that data as your personal data held in custody on your behalf. 9 Realms' obligations as an API consumer under applicable developer agreements remain independently binding; your consent to data sharing cannot override those obligations.

You grant 9 Realms a limited, non-exclusive right to access, store, and process User Data for the purpose of providing, maintaining, and improving the Services.

9 Realms retains all rights in Platform Outputs. You are granted a limited, non-exclusive licence to use Platform Outputs for personal or internal purposes only.

8A. Connected Game Accounts

Where you choose to connect a Third-Party Game Platform account (a "Connected Account"), you authorise 9 Realms to access and retrieve your gameplay data from that account through the applicable platform's official API or authorisation mechanism, acting on your behalf. The platforms currently supported are listed at supernovaiq.com/platforms — this list is updated as new integrations go live, without requiring an amendment to these Terms.

You may connect or disconnect a Connected Account at any time through your account settings. Disconnection will stop future data retrieval from that platform. Data already retrieved and stored prior to disconnection will be retained in accordance with Section 6 (Data Retention) unless you submit a deletion request.

9 Realms operates as a developer and API consumer under the separate terms of each Third-Party Game Platform. Your authorisation to retrieve data does not alter or limit 9 Realms' obligations under those developer agreements. We will take reasonable steps to ensure our data handling remains consistent with applicable platform policies; however, changes to Third-Party Game Platform APIs or terms may affect the availability of certain features, and 9 Realms accepts no liability for any such unavailability.

9 Realms does not guarantee continued access to any Third-Party Game Platform's API or data services.

8B. Affiliated Brand Data Sharing

9 Realms operates an ecosystem of Affiliated Brands. Where you choose to create an account with, or link your Supernova iQ account to, an Affiliated Brand, the following applies.

By creating an account with, or signing up to, an Affiliated Brand:

Prior to your account being connected to any Affiliated Brand, you will be presented with a clear notice identifying the relevant Affiliated Brand, describing the categories of User Data to be transferred, and the purposes for which that data will be used. Your explicit consent will be obtained at that point before any transfer takes place.

Data transferred to an Affiliated Brand is governed by that brand's own terms and conditions and privacy policy from the point of transfer. You should review those documents before signing up to an Affiliated Brand.

You may revoke your authorisation for data sharing with a specific Affiliated Brand at any time by disconnecting the relevant account through your account settings, or by contacting us at privacy@supernovaiq.com. Revocation will prevent future transfers to that Affiliated Brand. Data already transferred prior to revocation is subject to that Affiliated Brand's own retention and deletion policies.

9 Realms will only transfer User Data to Affiliated Brands within the constraints of applicable Third-Party Game Platform developer agreements and applicable law.

9. Intellectual Property

All rights in the Services are owned by 9 Realms or its licensors.

You are granted a limited, non-exclusive licence to use the Services for the purposes contemplated by these Terms.

You must not: (a) modify or reproduce the Services; (b) reverse engineer the Services; (c) use the Services commercially without prior written consent; or (d) remove or alter any proprietary notices.

10. User Content

You retain ownership of User Content.

You grant 9 Realms a non-exclusive, worldwide, royalty-free licence to use User Content to the extent necessary to operate and improve the Services.

You must ensure that User Content complies with applicable laws and does not infringe the rights of any third party.

9 Realms may remove User Content that it reasonably believes breaches these Terms or applicable law.

11. Service Availability & Changes

We do not guarantee uninterrupted or error-free operation of the Services.

We may modify or discontinue any part of the Services at any time.

We will provide notice of material changes where reasonably practicable.

12. Disclaimers

The Services are provided on an "as is" and "as available" basis.

To the extent permitted by applicable law, we make no warranties regarding the Services, whether express, implied, or statutory.

Platform Outputs are informational only and do not constitute advice of any kind.

We do not guarantee any outcomes, results, or performance.

12A. AI and Model Limitations

The Services utilise artificial intelligence, machine learning models, and automated systems to generate Platform Outputs. Such outputs may be based on incomplete, inaccurate, delayed, or evolving data and models, and may not reflect real-world conditions or outcomes.

Platform Outputs may contain errors, omissions, or limitations and should not be relied upon as definitive, complete, or authoritative.

9 Realms does not guarantee the accuracy, completeness, reliability, or suitability of any Platform Outputs generated through the Services.

Users acknowledge that AI-generated insights are probabilistic in nature and may change over time as models are updated, retrained, or improved.

13. Limitation of Liability

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under applicable law, including the Australian Consumer Law, the EU Consumer Rights Directive, the UK Consumer Rights Act 2015, or any other applicable mandatory consumer protection legislation.

To the maximum extent permitted by applicable law, 9 Realms excludes all liability for any indirect, incidental, special, or consequential loss, including loss of profits, data, goodwill, or opportunity arising from or in connection with the Services.

Where liability cannot be excluded, 9 Realms' liability is limited, at its option, to: (a) the re-supply of the Services; or (b) the cost of having the Services supplied again.

Nothing in these Terms limits 9 Realms' liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by law.

14. Indemnity

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless 9 Realms against any third-party claims, losses, damages, and expenses (including reasonable legal costs) arising from: (a) your wilful misconduct or gross negligence in connection with the Services; or (b) your material breach of these Terms.

This indemnity does not apply to the extent any claim arises from 9 Realms' own negligence, breach of these Terms, or breach of applicable law.

15. Suspension & Termination

We may suspend or terminate access to the Services where we reasonably believe these Terms are materially breached, where required by law, or where we reasonably believe a risk arises from continued access.

Where we terminate access other than for your breach or a legal requirement, we will provide at least [30] days' advance notice unless immediate termination is necessary to prevent harm.

You may stop using the Services and close your account at any time through your account settings.

Upon account closure or termination, your right to use the Services ceases and we will process the deletion of your User Data in accordance with Section 6 (Data Retention) and our Privacy Policy. You may request an export of your User Data prior to closure.

Where access is terminated due to your breach of these Terms, no refunds will be provided except where required by applicable law.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of Victoria, Australia.

Subject to the paragraph below, disputes arising from or in connection with these Terms will be referred to and finally resolved by arbitration in Victoria, Australia, in accordance with the arbitration rules agreed between the parties.

Nothing in this section affects your rights as a consumer under the mandatory laws of your country of residence. EU consumers retain the right to bring proceedings before the courts of their country of habitual residence, and UK consumers retain the right to bring proceedings before the courts of England and Wales, Scotland, or Northern Ireland (as applicable).

Nothing in these Terms prevents either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.

17. GDPR and UK GDPR — Rights of EU and UK Users

This section applies to Users located in the European Economic Area (EEA) or United Kingdom. Nothing in these Terms limits your rights under the GDPR, UK GDPR, or other applicable data protection law.

If you are located in the EEA or UK, you have the following rights in relation to your Personal Data:

  • Right of Access The right to request a copy of the Personal Data we hold about you and information about how we use it.
  • Right to Rectification The right to request correction of inaccurate or incomplete Personal Data.
  • Right to Erasure The right to request deletion of your Personal Data where it is no longer necessary for the purposes for which it was collected, or where you withdraw consent and there is no other lawful basis for continued processing.
  • Right to Restriction The right to request that we restrict processing of your Personal Data in certain circumstances.
  • Right to Data Portability The right to receive your Personal Data in a structured, commonly used, machine-readable format and to transmit it to another controller where processing is based on consent or contractual necessity.
  • Right to Object The right to object to processing of your Personal Data based on our legitimate interests, including for direct marketing purposes.
  • Right to Withdraw Consent Where processing is based on consent, the right to withdraw consent at any time. Withdrawal does not affect the lawfulness of processing carried out prior to withdrawal.

To exercise any of these rights, please contact us at privacy@supernovaiq.com. We will respond within 30 days and will not charge a fee unless the request is manifestly unfounded or excessive.

You have the right to lodge a complaint with the supervisory authority in your country of residence. In the United Kingdom, this is the Information Commissioner's Office (ico.org.uk). EU residents should contact their relevant national data protection authority.

18. US Privacy Rights

Users in Virginia, Colorado, Connecticut, and other US states with applicable privacy legislation have similar rights under their respective state laws. Contact us at privacy@supernovaiq.com to exercise them.

19. Miscellaneous

These Terms constitute the entire agreement between you and 9 Realms in respect of the Services and supersede all prior agreements or understandings.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

We may update these Terms from time to time. We will provide at least [14] days' notice of material changes via email or a notice within the Services. Continued use of the Services after the effective date of any update constitutes acceptance of the updated Terms.

Failure to enforce any right or provision under these Terms will not constitute a waiver of that right or provision.

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a related entity or successor without your consent, provided we give you reasonable notice.
